dc.description.abstractEste trabalho analisa a temática das fake news, de forma a debater onde este evento se situa na sociedade da informação e quais são seus efeitos em relação ao Estado Democrático de Direito. Ele aborda o argumento de que o combate às fake news poderia levar ao aumento da censura, posicionando-se contrário a este entendimento, tendo em vista que a notícia falsa não está protegida pela liberdade de expressão. Este estudo foi elaborado a partir de uma revisão crítica da literatura sobre o tema que permitiu concluir que a desinformação em larga escala é um grande perigo atual, na medida em que incentiva atitudes antidemocráticas e crimes fundamentados no discurso de ódio. Defende, portanto, que o Estado em suas três esferas de Poder - Executiva, Legislativa e Judiciária - deve agir de forma adequada para conter danos advindos deste evento.
dc.description.abstractThis work analyses the t opic of fake news, in order to discuss where this event is situated in the information society and what are its effects in relation to the Democratic Rule of Law. The following text adresses the argument that combating fake new s can lead to increased censorship, althought, at the end, it concludes contrary to such understanding , concluding that desinformation is not protected by freedom of expression. Through a study assembled from a bibliographical review of v arious authors and texts on the subject, it is concluded that large escale disinformation is a present and serious threat that encourages anti democratic attitudes an d promotes crimes and hate speech. This work, therefore, defends that the State in its t hree sph e res of Power, Executive, Legislative and Judiciary, must act, in an adequate form, to contain damages caused by this event.
