Resumo
Nos últimos anos, a medicina tem encontrado grande esperança em relação aos
avanços da biotecnologia, principalmente nos avanços da área de edição genética, os quais,
por meio da manipulação de genes, tornaram possível a cura de diversas doenças genéticas
que afrontam a humanidade, desde os primórdios. Entretanto, surgem diversos riscos em
relação às formas e aos fins, pelos quais a manipulação genética será realizada, essas ameaças
afrontam não só o patrimônio genético da geração atual, mas também o da futura geração,
além de ameaçar as formas de configuração social e moral das sociedades. O presente
trabalho tem como proposta refletir sobre essa antítese, através dos princípios da bioética, do
biodireito e dos direitos humanos, ferramentas fundamentais em relação ao tema, analisando
os direitos naturais e positivados existentes. Além de demonstrar como o direito tem a função
de proteger os dados genéticos e a identidade genética da humanidade, garantido assim o
direito fundamental a uma vida digna para as futuras gerações.
In recent years, medicine has found great hope in relation to advances in biotechnology, especially in advances in the area of gene editing, through the manipulation of genes made possible the cure of various genetic diseases that afflict humanity since the beginning. However, several risks arise in relation to the ways and purposes for which genetic manipulation will be carried out, and these threats affect not only the genetic heritage of the current generation, but also that of future generations, in addition to threatening the social and moral configuration of societies. The present work aims to reflect on this antithesis, through the principles of bioethics, bio-law, and human rights, fundamental tools in relation to the theme, analyzing the existing natural and established rights. In addition to demonstrating how the law has the function of protecting genetic data and the genetic identity of humanity, thus guaranteeing the fundamental right to a dignified life for future generations.
