| dc.description.abstract | Ao considerar que o Direito é uma ciência que se consolida com o desenvolvimento do capitalismo, o presente trabalho pretendeu demonstrar a relação direta deste com a questão identitária, distinguindo identidade de identitarismo. Assim, foi necessário percorrer especificamente pela história de ideias que construíram as concepções de Direito, sujeito de direito, forma jurídica e legalização, bem como as relações destes elementos com o Estado e a ascensão da burguesia. Para tanto, utilizaram-se os estudos de Evguiéni Pachukanis e Bernard Edelman. Além de apresentar a conexão destes conceitos com a construção histórico-social do fenômeno identitário, trazido à luz pelo Coletivo Combahee River e o historiador Asad Haider, objetivou-se uma análise com ênfase no Movimento LGBTQIA+. A pesquisa se deu, portanto, com base na contextualização histórico-social destas abstrações e, na aplicação de uma crítica marxista acerca do Direito e do identitarismo, à luta LGBTQIA+ e a concretização de seus direitos. Diante do exposto, constatou-se que há dificuldades impostas pela legalização e pela forma jurídica, que impedem a emancipação desta comunidade, que é cooptada pelos ideais do capital, culminado em um identitarismo esvaziado, que obsta um projeto político definitivo a fim de erradicar a problemática da discriminação. | pt_BR |
| dc.description.abstract | By considering that Law is a science that is consolidated with the development of capitalism, this paper aims at presenting the direct connection between Law and identity politics, distinguishing the latter from identity itself. Thus, it was necessary to go specifically through the history of ideas that built the conceptions of Law, legal subject, legal forms and legalisation, as well as the relations of these elements with the State and the rise of the bourgeoisie. These concepts were presented based on Evguiéni Pachukanis and Bernard Edelman studies. In addition to presenting the link of these concepts with the historical-social build of the identity politics phenomenon, concept brought to light by the Combahee River Collective and by the historian Asad Haider, it is intended an analysis with an emphasis on the LGBTQIA + Movement. Therefore, the research took place based on the historical-social contextualisation of these abstractions and the application of a Marxist criticism to the general theory of Law and identity politics, to the LGBTQIA + struggle for the realisation of their rights. In light of the foregoing, it was found that there are difficulties imposed by legalisation and the legal forms, which prevent the emancipation of this community, that is co-opted by the ideals of capital, culminating in empty identity politics, which refrain from a definitive political project in order to eradicate the discrimination problem. | pt_BR |
