O presente trabalho tem como tema central o direito à Educação Especial Inclusiva da pessoa com deficiência intelectual no sistema de ensino regular brasileiro. Busca-se compreender como se deu a construção legislativa brasileira desse direito e a sua eficácia no contexto educacional atual. Além disso, pretende-se demonstrar como se consolidou o conceito de deficiência intelectual utilizado atualmente. Nesse sentido, a inclusão escolar impõe a organização e modificações do sistema de ensino, de modo a proporcionar uma proposta de aprendizado inclusiva e eficaz. Contudo, apesar de amplamente garantido em normas e políticas nacionais, o princípio inclusivo não vem sendo cumprido de forma absoluta. Através de uma análise bibliográfica e estatística, pretende-se demonstrar que a ausência de preparo de instituições de ensino e de professores, no atendimento da pessoa com deficiência intelectual, prejudica seu desenvolvimento educacional e inclusivo, implicando na ineficácia da norma brasileira.
The main theme of this study is the legal right to Inclusive Special Education for people with intellectual disabilities in the Brazilian regular education system. It seeks to understand how this legal right was built in the Brazilian legislative system and its effectiveness in the current educational context. In addition, it is intended to demonstrate how the concept of intellectual disability currently used was consolidated. An Inclusive School requires organization and modifications of the education system, in order to provide an inclusive and effective learning proposal. However, despite being widely guaranteed in national laws and policies, the inclusive principle has not been fulfilled. Through a bibliographic and statistical analysis, it intends to demonstrate that the lack of preparation of educational institutions and teachers, in the care of people with intellectual disabilities, has a negative impact on their educational and inclusive development, implying ineffectiveness of Brazilian standard.
