O envelhecimento da população e as tendências nas taxas de participação na força de trabalho
estão criando um impacto considerável sobre os programas públicos de pensões em todo o
mundo. Existe uma literatura importante sobre o momento da aposentadoria e durante a vida
profissional, mas não se sabe muito sobre isso em economias menos desenvolvidas, nem sobre
as tendências futuras. A Previdência Social foi criada com a intenção de proteger a classe
trabalhadora de riscos sociais como doenças, incapacidades, envelhecimento, morte e
desemprego que afetavam a população como um todo e afetavam a capacidade de sustento dos
trabalhadores e seus dependentes. A aposentadoria especial surge nesse contexto como um
benefício direcionado especificamente àqueles que se encontram expostos em seu ambiente de
trabalho a agentes químicos, físicos e biológicos nocivos que podem prejudicar sua saúde e/ou
integridade física. O referido benefício sofreu diversas modificações ao longo dos anos,
dificultando sua obtenção pelos segurados. Portanto, o objetivo do presente estudo é examinar o
desenvolvimento histórico e as características do benefício único de aposentadoria antes e depois
da adoção da EC nº 103/2019. O objetivo deste artigo é analisar o conceito de presunção, sua
história, tratamento jurídico e interpretação judicial conforme estabelecido pelo legislador e pelo
poder judiciário, em especial o adicional de vinte e cinco e cinquenta por cento concedido ao
falecido independentemente do tipo de aposentadoria em que o segurado faleceu. O trabalho se
fundamenta em diversos posicionamentos filosóficos e jurídicos diametralmente opostos sobre
a utilização desse benefício. Os princípios da dignidade humana, igualdade e o papel de apoio
do complemento são destacados.
Population aging and trends in labor force participation rates are having a considerable impact on public pension programs around the world. There is an important literature on the timing of retirement and during working life, but not much is known about this in less developed economies or about future trends. Social Security was created with the intention of protecting the working class from social risks such as illness, disability, aging, death and unemployment that affected the population as a whole and affected the livelihood of workers and their dependents. The singular retirement appears in this context as a benefit specifically aimed at those who are exposed in their work environment to harmful chemical, physical and biological agents that can harm their health and/or physical integrity. This benefit has undergone several changes over the years, making it difficult for policyholders to obtain it. Therefore, the objective of the present study is to examine the historical development and characteristics of the single retirement benefit before and after the adoption of EC nº 103/2019. As a result, a narrative and documentary review of the literature is used, together with an analysis of national legislation as it is and as it is expected, as well as books and scientific articles that address the topic. The information and data collected through the survey were analyzed to determine how the changes brought about by EC nº 103/2019 affect the health, physical integrity and livelihood of the worker.This article's purpose is to analyze the concept of presumption, its history, legal treatment, and judicial interpretation as established by the legislator and the judicial branch, in particular the additional twenty-five and fifty percent provided to the deceased regardless of the type of aposentadoria in which the insured passed away. The work is based on several diametrically opposed philosophical and legal positions about the use of this benefit. The principles of human dignity, equality, and the supportive role of the complement are highlighted.
