O objetivo deste trabalho de conclusão de curso consiste em analisar a competência do direito na regulamentação de questões presentes na indústria da moda, incluindo a concorrência desleal. É importante observar que, isoladamente, o direito não é capaz de atender à necessidade de proteção jurídica na indústria da moda, o que justifica a criação do fashion law. Para isso, foi realizado um estudo de caso que analisa o conflito entre Christian Louboutin e Yves Saint Laurent, duas grandes empresas da moda, que deu início às discussões judiciais sobre conflitos na indústria da moda e evidencia a necessidade de uma área interdisciplinar entre o direito e a moda. Através da análise desse caso, será possível compreender de que maneira essas práticas impactam as empresas envolvidas e o mercado como um todo, além de apresentar os desafios atuais enfrentados pela indústria da moda.
The aim of this final thesis is to analyze the competence of law in regulating issues present in the fashion industry, including unfair competition. It is important to note that law alone is not capable of meeting the need for legal protection in the fashion industry, which justifies the creation of fashion law. For this purpose, a case study was carried out analyzing the conflict between Christian Louboutin and Yves Saint Laurent, two major fashion companies, which sparked judicial discussions on conflicts in the fashion industry and highlights the need for an interdisciplinary area between law and fashion. Through the analysis of this case, it will be possible to understand how these practices impact the companies involved and the market, as a whole, as well as present the current challenges faced by the fashion industry.
