O objetivo do presente estudo é abordar a concorrência desleal no mundo da moda e a violação de propriedade intelectual dos designers, tratando conceitos que abarcam o tema como direito autoral, patentes, marcas e a importância da proteção à propriedade intelectual e a utilização do trade dress, tomando como exemplo a disputa judicial entre as marcas Mario Valentino e Valentino Garavani. O estudo justifica-se pela necessidade de um debate acerca dos setores da área da moda no tocante à concorrência lícita e ilícita. Para tanto, utilizou-se a metodologia de pesquisa bibliográfica com foco na legislação, jurisprudência e análise do conflito envolvendo o uso da marca Valentino, por meio de revisão bibliográfica. Como resultado, verifica- se que as práticas de concorrência ilícita impactam as empresas e, consequentemente, o mercado, além de trazer desafios enfrentados pela indústria da moda.
The objective of this study is to address unfair competition in the world of fashion and the violation of designers' intellectual property, dealing with concepts that encompass the topic such as copyright, patents, trademarks and the importance of protecting intellectual property and the use of trade dress, taking as an example the legal dispute between the brands Mario Valentino and Valentino Garavani. The study is justified by the need for a debate about the fashion sectors in terms of legal and illicit competition. To this end, a bibliographical research methodology was used focusing on legislation, jurisprudence and analysis of the conflict involving the use of the Valentino brand, through a bibliographical review. As a result, it appears that illicit competition practices impact companies and, consequently, the market, in addition to bringing challenges faced by the fashion industry.
