dc.description.abstractAs relações humanas e a economia se tornaram cada vez mais complexas ao longo da história, de modo que “a função social do Estado” e a sua atuação na sociedade, não faziam mais sentido à população, por não atender aos interesses individuais e da coletividade. Os questionamentos quanto ao modelo de Estado marcou o movimento iluminista e se faz presente até os dias de hoje. Estes questionamentos trouxeram à tona antigos questionamentos filosóficos, desde a antiguidade. Assim, a busca por direitos civis e políticos desencadearam nas Revoluções Burguesas do século XVII e XVIII, fazendo com que o Estado deixasse de ser absolutista e passássemos ao Estado Liberal. Ainda, com o passar dos anos, outras formas de Estado surgiram na sociedade, como o Estado Social, decorrente da Revolução Russa e das Constituições de Mexicana e de Weimar. Contudo, todos estes modelos não se mostraram adequados a garantir direitos em um modelo democrático. Pensando nisso e na pluralidade cultural do nosso país, os constituintes de 1988 quando da promulgação, optaram por acolher o Estado Democrático e Social de Direito. Neste modelo, o papel do Poder Judiciário e o Acesso à Justiça são preceitos basilares para a manutenção do status do Estado pelo fato de garantirem à ordem e a paz social. Assim, o presente Trabalho se justifica pela importância da manutenção da democracia-social, previsto na Constituição Federal, com a promoção do “bem-estar social” assegurado pelo “Acesso à Justiça” sobre este regime de governo.pt_BR
dc.description.abstractHuman relations and the economy became increasingly complex throughout history, so that “the social function of the state” and i role in society no longer made sense to the population, as it did not meet individual and collective interests. . The questions about the state model marked the “Enlightenment movement and is present to this day. These questions brought to light ancient philosophical questions from antiquity. Thus, the search for civil and political rights triggered in the bourgeois revolutions of the seventeenth and eighteenth century, causing the state to cease to be absolutist and move to the Liberal State. Still, over the years, other forms of state emerged in society, such as the Social State, resulting from the Russian Revolution and the Constitutions of Mexicana and Weimar. However, all these models were not adequate to guarantee rights in a democratic model. Thinking about this and the cultural plurality of our country, the 1988 constituents at the time of enactment chose to embrace the Democratic and Social Rule of Law. In this model, the role of the judiciary and access to justice are basic precepts for maintaining the state's status by ensuring order and social peace. Thus, this paper is justified by the importance of maintaining social democracy, provided for in the Federal Constitution, with the promotion of "social welfare" ensured by the "Access to Justice" under this regime of government.pt_BR
