A violência na assistência ao parto se tornou um assunto recorrente no cenário
brasileiro, em especial pelo desrespeito contínuo à autonomia da
gestante-parturiente pelos médicos e demais profissionais da saúde que integram o
contexto de parto. O Brasil não detém um conceito que defina o que é violência
obstétrica, bem como não dispõe de tipificação penal no ordenamento jurídico para
criminalizar as violências que podem ocorrer durante a assistência ao parto,
acarretando clara insegurança jurídica. Face ao observado, foi analisado o modelo
de assistência ao parto no Brasil, investigando as limitações da autonomia da mulher
e além do incisivo desrespeito desta, buscando pelos reflexos penais das condutas
médicas violentas, constatando a necessidade de uma norma penal que trata
fundamentalmente da violência obstétrica, dentro e fora da assistência ao parto e se
mostrando indispensável a sua conceituação. O presente estudo foi elaborado
através da metodologia básica, com abordagem qualitativa e método dedutivo,
pautado pela doutrina brasileira, publicações nacionais e internacionais de artigos e
teses, além de legislações brasileiras e legislações internacionais que tratam
efetivamente sobre o tema.
Violence in childbirth care has become a recurring issue in the brazilian scenario, especially due to the continuous disrespect for the autonomy of pregnant women in labor by doctors and other health professionals who are part of the birth context. Brazil does not have a concept that defines what obstetric violence is, nor does it have a criminal classification in the legal system to criminalize violence that may occur during childbirth care, resulting in clear legal uncertainty. In view of what was observed, the birth care model in Brazil was analyzed, by investigating the limitations of women's autonomy, in addition to the aforementioned disrespect, looking for the criminal consequences of violent medical conduct, noting the need for a criminal legislation that fundamentally deals with obstetric violence, inside and outside childbirth care, proving to be indispensable to its conceptualization. The present study was carried out using basic methodology, with a qualitative approach and deductive method, guided by brazilian doctrine, national and international publications of articles and theses, in addition to brazilian legislation and international legislation that effectively deal with the topic.
