Abstract
O presente trabalho tem como finalidade o estudo do instituto da Infiltração de Agentes como meio de produção de provas no combate à criminalidade organizada. O trabalho se baseia na análise da doutrina e ordenamento jurídico brasileiro, em especial à Lei 12.850/2013. O primeiro grande assunto abordado será o conceito, funcionamento, evolução e tipificação das organizações criminosas. Dessa forma, o conhecimento sobre as ameaças do crime organizado possibilita o estudo aprofundado sobre a Infiltração de Agentes no combate eficaz às organizações criminosas. Ao final, o trabalho passará a analisar então os temas que geram grande discussão na doutrina: Os direitos do policial e os limites a serem respeitados durante a infiltração, incluindo a responsabilização penal em caso de cometimento de crimes pelo agente infiltrado, bem como a possibilidade da atuação do policial infiltrado como testemunha durante o processo criminal.
This paper aims to study the Institute of Agent Infiltration as a means of producing evidence in the fight against organized crime. The work is based on the analysis of Brazilian legal doctrine and order, especially Law 12.850 / 2013. The first major subject addressed will be the concept, operation, evolution and typification of criminal organizations. In this way, the knowledge about the threats of organized crime enables the in-depth study of Agent Infiltration in the effective fight against criminal organizations. Finally, the work will then analyze the themes that generate great discussion in the doctrine: The rights of the police and the limits to be respected during the infiltration, including criminal liability in case of crimes committed by the infiltrated agent, as well as the possibility the role of the infiltrated police as a witness during the criminal process.
