A presente monografia apresenta como objeto de estudo a substituição fideicomissária,
disciplinada pelo Código Civil Brasileiro. Composta por três capítulos, objetivou-se a
exposição com o método histórico analítico, para atingir o objetivo primordial consistente na
defesa da capacidade de fideicomissário aos filhos adotivos, à prole eventual e aos embriões
criopreservados, em tempos atuais e futuros. Na primeira parte, foi feito um detalhamento
histórico do direito constitucional à herança, culminando nas influências de ambos os
ordenamentos romano e francês ao ordenamento jurídico brasileiro e as significativas mudanças
no direito de família e sucessões introduzidas pela Constituição Federal de 1988. Na segunda
parte, abordou-se as substituições testamentárias vulgar, plúrima e fideicomissária, verificandose,
ainda, a origem no Direito Romano, a introdução deste no ordenamento jurídico brasileiro
e as modalidades do fideicomisso. A terceira parte da presente monografia demonstra, com base
em questões reflexivas, os elementos para a constituição do fideicomisso, os direitos e deveres
do fiduciário e do fideicomissário; as hipóteses que levam a caducidade ou nulidade do instituto,
para abordar as controvérsias no fideicomisso entre a autonomia do testador e o fideicomissário.
O estudo da substituição fideicomissária não é um tema contemporâneo, notadamente pois,
desde os primórdios no Direito Romano, resguardavam-se os aspectos tradicionais do instituto.
Não por outro motivo, a maleabilidade do instituto é considerada como baluarte, pois, a despeito
das rigorosas reprimendas, o fideicomisso permanece agregando ao direito privado até a
atualidade, projetando-se aos tempos pósteros como viabilizador da proteção de indivíduos, até
então desconsiderados ou desconhecidos pela sociedade e pelo ordenamento jurídico.
The monograph presents as an object the study of fideicommissary substitution, disciplined in the Brazilian Civil Code. Composed by three chapters, the objective of the exhibition was to use the historical analytical method to achieve the primary objective of defending the capacity of the adopted children, offspring, and cryopreserved embryos to be fideicommissaries, in current and future times. In the first chapter, a historical detailing of the constitutional right to inheritance was made, culminating in the influences of both the Roman and French systems to the Brazilian legal system and the significant changes in family law and successions introduced by the Federal Constitution of 1988. In the second chapter, different types of substitutions were addressed, also verifying the origin of Roman law, its introduction into the Brazilian legal system and the modalities of trust. The last chapter demonstrates, from reflective questions, the elements for the constitution of the fideicommissary substitution; the rights and duties of the fideicommissary and the fiduciary heir; the hypotheses that lead to the expiry or nullity of the institute, to address the controversies in the trust between the autonomy of the testator and the fideicommissary. The study of fideicommissary substitution is not a contemporary theme, remarkably because, since the beginning of Roman law, the traditional aspects of the institute were protected. For no other reason, the malleability of the institute is considered as a bulwark, because, despite the strict reprimands, the trust remains adding to private law until today, projecting itself to the times afterwards as a viable protection for individuals yet disregarded or unknown society and the legal system.
