dc.description.abstractThis work intends to develop a critical analysis of transformations that occurred in the Brazilian Civil Process, as an instrument structured by the capitalist economic logic. Surveys about the General Process Theory and its liberal genesis we made. In sequence, based on the regulation approach and the State derivation debate, it became evident that not only the functioning of capitalism is mediated by a political apparatus separated from the economic agents (State), as this sociability is structured by legal and procedural links. In accordance with the legal, economic and philosophical thinking of modern and contemporary authors, the apprehensions of civil procedural evolution in the national scenario were presented in order to demonstrate that the transformations occurred as a result of the cyclical phenomenon of overcoming crises, inherent in the capitalist system and according to the liberal order. From the finding of non- neutrality of civil procedural law, we moved forward with the analysis of procedural reform that took place in the 21st century, which remodeled the civil process as a dynamizing tool for the neoliberal economy. In the end, after examining some of the institutes belonging to the current Code of Civil Procedure, valuable topics to neoliberal capitalism were dealt with, such as (i) the flexibility of the process due to the freedom of choice; (ii) the approximation of the civil procedural system to the common law and (iii) the institutionalization of self-composing methods in the judicial process.eng
