Abstract
O presente artigo versa sobre a relação jurídica entre os motoristas e a empresa
UBER, trazendo uma contextualização sobre o direito do trabalho e seus princípios,
buscando responder o seguinte questionamento: Há possibilidade de vínculo
empregatício entre a empresa UBER e seus motoristas? Nesse contexto, são
analisados os requisitos fático-jurídicos da relação de emprego. Ato contínuo, estudase
a diferença entre relação de emprego e relação de trabalho. Por fim, realiza-se
uma pesquisa jurisprudencial nas quais a empresa figurou no polo passivo.
The present article examined the issue on the legal relationship between the drivers and the UBER company, bringing a contextualization about labor law and its principles, seeking to answer the following question: Is there a possibility of an employment relationship between the UBER company and its drivers? In this context, the factual and legal requirements of the employment relationship are analyzed. Subsequently, the difference between employment relationship and employment relationship is studied. Finally, a jurisprudential research is carried out in which the company appeared in the passive pole.
