| dc.description.abstract | Este trabalho versa sobre a abordagem da dignidade sexual e de gênero nos estatutos dos Tribunais Penais Internacionais ad hoc de Ruanda e Ex-Iugoslávia. O recorte escolhido foi para esses tribunais instituídos por conta de guerras do final do século XX para exame da evolução do direito penal internacional na adequação às transformações sociais no quesito de gênero. Para tanto, analisou-se primeiro discussões do feminismo do período, como liberdade sexual e emancipação feminina. Posteriormente, com o histórico das guerras pretendeu-se montar o cenário para o estudo dos estatutos. E então a avaliação dos estatutos dos tribunais de Nuremberg e Tóquio, em comparação com os estatutos-alvo do trabalho, evidenciou uma mudança no tópico, passando a figurar o estupro de guerra como crime contra a humanidade. Concluiu-se que houve evolução na área, e que esta poderá ser continuada conforme vejam-se discussões crescentes dos direitos à dignidade sexual e de gênero. | pt_BR |
| dc.description.abstract | This paper addresses the approach to sexual and gender dignity in charters of the ad hoc International Tribunals of Rwanda and Yugoslavia. These courts were chosen because they were instituted for wars of the late twentieth century, and then it is possible to examine the evolution of international criminal law in adapting to social changes in terms of gender. Therefore, feminism discussions of the period were analyzed, such as sexual freedom and female emancipation. Later, with the history of the wars it was intended to set the stage for the study of the charters. And then the assessment of the statutes of Nuremberg and Tokyo courts, compared with the target statutes, evidenced a change in the topic, making war rape a crime against humanity. The conclusion is that there have been developments in the subject, and this may be continued as increasing discussions of rights to sexual and gender dignity are seen. | pt_BR |
