Resumo
O seguinte trabalho lida com o estudo dos direitos autorais e como os mesmos
seriam aplicados a músicas feitas por Inteligências Artificiais por meio da metodologia
hipotético-dedutiva, bem como a forma em que o avanço da tecnologia irá afetar as
legislações hoje presentes. Foi utilizada a análise e comparação de doutrinas, legislações,
e a gênese da internet como passada inovação tecnológica que causou grandes impactos
nas leis autorais e na vida das pessoas. Com base nesse estudo, foi possível compreender
o valor de avanços tecnológicos, porém também a responsabilidade para que se possa
regulá-los de forma que sejam protegidos os direitos dos artistas que seriam afetados.
Assim, levanta-se que as Inteligências Artificiais devem ser limitadas em suas
capacidades no mercado musical, devendo os criadores de tais músicas geradas registrar
as músicas e autores utilizados no processo de “learning” das IAs, e que seja necessária a
permissão do autor da música original para esse processo para que a música feita por IA
possa ser publicada.
The following Project delas with the study of copyright law and how it could be applied to music made by Artificial Intelligence, by means of the hypothetic deductive methodology, as well as the form in which the advance of technology could affect current day legislation. It was utilized the analysis and comparison of doctrines, legislation, and the genesis of the internet as a past technological innovation that caused great impact in copyright law and people’s lives. On the basis of this study, it was possible to comprehend the value of technological advancements, but however, also the responsibility to regulate them in a way that the rights of artists who could be affected are protected. In that way, it is raised that the Artificial Intelligences should be limited in their capabilities in the musical market, with the creators of said generated music having to register the song and authors used on the AI ‘learning’ process, and that the permission of the original songs author is necessary for the AI song to be published.
