O trabalho traz uma base teórica acerca do controle de constitucionalidade, apresentando para tanto o modelo Francês, referencia ao se tratar desse assunto, onde um Conselho Constitucional recebe as funções de realizar os controles preventivo e repressivo de constitucionalidade. Foi apresentado um breve histórico do controle de constitucionalidade no Brasil até a Constituição de 1988, que trouxe novidades e avanços em matéria de controle preventivo de constitucionalidade sem retroceder ao que já havia sido posto nessa matéria. Foi apresentado algumas características do controle preventivo no Brasil após 1988, como também a análise desse instituto do ponto de vista de órgãos que possuem esse poder de forma incidental, como é caso dos Poderes Executivo e Judiciários, abordando, com relação a esse último, a hipótese de um possível controle preventivo exercido por esse no Brasil. A análise buscou os meandros do controle preventivo no Poder que o realiza de maneira mais contundente, apontando algumas características do seu regimento interno das Casas do Poder Legislativo Federal, buscando as regras e os instrumentos que elas dispõem para esse exercício, apontando, quando pertinente, eventuais falhas em seu modelo, para se então concluir que o modelo de controle preventivo funciona, mas carece de melhoras.
The paper offered a theoretical basis on the control of constitutionality, applied for both the French model, reference when dealing with this subject, where a Constitutional Council receives the functions of carrying out preventive and repressive controls of constitutionality. A brief history of constitutionality control in Brazil was presented until the 1988 Constitution, which brought news and advances in the matter of preventive control of constitutionality without going back to what had already been put in this matter. Then, some characteristics of preventive control in Brazil after 1988 were presented, as well as the analysis of this institute from the point of view of bodies that have this power incidentally, as is the case of the Executive and Judiciary Powers, addressing, with respect to the latter, the hypothesis of a possible preventive control exercised by him in Brazil. Finally, an analysis sought the intricacies of preventive control in the Power that carries it out in a more forceful way, specific characteristics of its internal regulation of the Houses of the Federal Legislative Power, seeking the rules and instruments that they limit for this exercise, to enable, when pertinent, flawed flaws in its model, to conclude that the preventive control model works, but lacks improvements.
