Resumo
O presente trabalho de conclusão de curso, que será desenvolvido na forma de artigo científico, desenvolver-se-á de maneira a analisar e conceituar o instituto jurídico da responsabilidade civil, traçando-se, para tanto, sua evolução histórica até o contexto do instituto na atualidade, com o intuito de se concluir pela aplicabilidade, nos contornos do atual ordenamento jurídico nacional que prevê tal instituto, da denominada “função punitiva da responsabilidade civil” e sua importância para a efetivação de seu objeto, qual seja, a tutela eficaz dos danos e de direitos fundamentais envolvidos, bem como sua importância preventiva no que tange à ocorrência dos danos na atual sociedade.
Para tanto, além de mencionada abordagem histórica e conceitual do instituto jurídico da responsabilidade civil e de suas funções, far-se-á uma análise comparativa do atual ordenamento jurídico brasileiro com o instituto dos punitive damages, consagrado em países anglo-saxões, notadamente nos Estados Unidos da América e na Inglaterra, que seguem o sistema jurídico do common law, de forma a concluir pela aplicabilidade da função punitiva da responsabilidade civil bem como de discutir os limites de sua aplicação.
Buscar-se-á, ademais, a realização de uma interpretação sistemática do ordenamento jurídico, notadamente com relação ao Código Civil atualmente em vigor, e a Constituição Federal de 1988, com o objetivo de se demonstrar que a aplicação da função punitiva da responsabilidade civil é importantíssima ferramenta para a própria efetivação da dignidade humana, bem como de seus direitos fundamentais decorrentes.
Com a finalidade de atingimento dos objetivos expostos utilizar-se-á como método a análise da doutrina pertinente à matéria, de artigos científicos e dos dispositivos legais incidentes.
The present course conclusion paper, which will be developed as a scientific article, will be developed in order to analyze and conceptualize the legal institute of civil liability, tracing its historical evolution to the context of the institute at present, in order to conclude by the applicability, in the contours of the current national legal order that foresees such institute, of the called “punitive function of the civil responsibility” and its importance for the realization of its object, that is, the effective protection of the damage and fundamental rights involved, as well as its preventive importance in relation to the occurrence of damage in today's society. Therefore, in addition to the historical and conceptual approach of the legal institute of civil liability and its functions, a comparative analysis of the current Brazilian legal system will be made with the punitive damages institute, consecrated in Anglo-Saxon countries, notably in the United States of America and England, which follow the common law legal system, in order to conclude on the applicability of the punitive function of civil liability and to discuss the limits of its application. In addition, a systematic interpretation of the legal system will be sought, especially in relation to the Civil Code currently in force, and the Federal Constitution of 1988, with the aim of demonstrating that the application of the punitive function of civil liability is a very important tool for the realization of human dignity, as well as its fundamental rights. In order to achieve the stated objectives, the analysis of the relevant doctrine, scientific articles and legal provisions will be used as method.
