O presente artigo tem como principal objetivo conduzir discussões e reflexões acerca do avanço e da validade jurídica dos contratos bancários celebrados por meio de assinatura eletrônica no contexto da era digital, visando demonstrar seus formatos diversos e confiabilidade. A celebração de negócios jurídicos bilaterais, evidenciadores da autonomia de vontade das partes, possuem o propósito de gerar obrigações, que correspondem a prestações e contraprestações². A assinatura eletrônica, por sua vez, representa a inovação tecnológica, resultado da demanda por um novo sistema jurídico validador da concordância entre as partes de forma mais prática e rápida. Já o sistema bancário é um dos maiores investidores em tecnologia no Brasil, buscando desenvolvimentos consistentes para atender aos seus clientes. Diante da pandemia causada pelo vírus COVID-19, que iniciou o ano de 2020 com efeitos sobre o país, exigindo que milhões de brasileiros fossem isolados em suas casas, executando atividades como trabalho e estudo por meio digital, houve uma aceleração de forma drástica do processo de instauração deste novo sistema, que já tinha tomado rumo iminente até mesmo anos antes, diante da presença da era digital, e dos novos formatos propostos por bancos digitais. Foi, portanto, um “mix” da exigência situacional, mas também o curso natural da evolução tecnológica pelo desejo dos contratantes. É diante deste panorama que a faz-se presente a análise pormenorizada do avanço e da validade no uso de assinaturas eletrônicas em contratos bancários dentro do ordenamento jurídico brasileiro em um contexto cada vez mais digital.
The main objective of this article is to conduct discussions and reflections about the development and legal validity of agreements entered into electronic signature, aiming to demonstrate the possible formats and security of this system. The execution of bilateral legal transactions, evidence of the parties' autonomy of will, have the purpose of generating obligations, which correspond to rights and dudies². The electronic signature, for it`s turn, represents technological innovation, the result of the demand for a new legal system that validates the agreement between the parties in a more practical and faster way. The banking system is one of the biggest investors in technology in Brazil, seeking consistent developments to serve its customers. Faced with the pandemic caused by the COVID-19 virus, which started the year 2019 with effects on the country, requiring that millions of Brazilians were isolated in their homes, performing activities such as work and study through digital means, there was a drastic acceleration of the process of this new system, which had already taken an imminent course even years before, given the presence of the digital age, and the new formats proposed by digital banks. It was, therefore, a “mix” of the situational requirement, but also the natural course of technological evolution by the contractors' desire. It is against this background that the detailed analysis of the progress and validity in the use of electronic signatures in banking contracts within the Brazilian legal system in an increasingly digital context as is the presente.
