Resumo
O objetivo do presente trabalho é analisar aspectos da responsabilidade civil utilizando-se
como base a doutrina especializada, bem como a legislação aplicável, como o Código Civil
Brasileiro e o Código de Defesa do Consumidor, demonstrando a aplicação prática do
instituto atualmente.
O cerne deste estudo é abordar a questão da responsabilidade civil de operadoras de planos de
saúde por erros assistenciais partindo do princípio de que essas não possuem controle sobre o
atendimento realizado por médicos e funcionários de hospitais e clínicas credenciadas. Desta
forma, temos a seguinte problemática: seria possível responsabilizar civilmente uma
operadora de planos de saúde por um erro médico que cause danos a seus consumidores? Em
caso positivo, quais os fundamentos para tal responsabilização? Que tipo de responsabilidade
civil pode ser aplicada em cada tipo de prestação de serviços que envolvem o caso, como do
médico, hospital e operadora de plano de saúde? Objetiva-se, então, entender qual a relação
jurídica entre operadoras de planos de saúde e seus médicos, clínicas e/ou hospitais
credenciados. Além de utilizar a legislação pertinente, a saber, Constituição Federal, Código
Civil, Código de Defesa do Consumidor, Lei nº 9.656/1998, dentre outras, em complemento a
análise será abordado o entendimento jurisprudencial atual, especialmente do Supremo
Tribunal de Justiça, Tribunal de Justiça do Estado de São Paulo e Tribunal de Justiça do Rio
Grande do Sul.
The purpose of this paper is to analyze aspects of civil liability using a specialized doctrine as a basis, as well as applicable legislation, such as the Brazilian Civil Code and the Consumer Protection Code, demonstrating the practical application of the institute today. The core, study is to address the issue of civil liability of health plan operators for care errors, assuming that they have no control over the care provided by doctors and employees of accredited hospitals and clinics. Thus, we have the following problem: would it be possible to hold a health insurance company civilly responsible for a medical error that causes damage to its consumers? If so, what are the grounds for such accountability? What type of civil liability can be applied to each type of service provision that involves the case, such as that of the doctor, hospital and health plan operator? The objective, then, is to understand the legal relationship between health plan operators and their accredited doctors, clinics and / or hospitals. In addition to using the relevant legislation, a saber, Federal Constitution, Civil Code, Consumer Protection Code, Law No. 9,656 / 1998, among others, in addition to the analysis, the current jurisprudential understanding, especially of the Supreme Court of Justice, Tribunal of Justice of the State of São Paulo and Court of Justice of Rio Grande do Sul.
