dc.description.abstractThis masters dissertation intends to analyze the legal limits of the punitive power in the scope of public contracting, since there is currently no minimum and uniform rule that guarantees the constitutional maxims when imposing administrative sanctions, this gap that damages the broad and unrestricted the right of defense of individuals and the regular exercise of the punitive power of the State, by removing the legitimacy of the punishment imposed is not in accordance with the performance of the Public Administration of a State of Law. In order for this objective to be achieved, it will be addressed, using the hypothetical-deductive method, its legal system and the infractions and penalties contained in the bidding legislation in kind, as well as the due process of sanction, analyzing each of its phases. Search contribute to the reflection and to point out in the end legal markers that guide the interpreter for a sanctioning application consistent with the values and principles of the Democratic State of Law because state punitive activity must be shaped by fundamental rights and guarantees.eng
