O artigo tem como finalidade analisar a posição sucessória do(a) companheiro(a),
tendo em vista que este(a) nem sempre teve o mesmo tratamento dado ao(a) cônjuge pela
legislação brasileira, sendo posicionado(a) de maneira inferior – inclusive com relação aos
demais herdeiros. O fato da união estável e do casamento serem entidades familiares distintas,
desigualou o(a) companheiro(a) do(a) cônjuge para fins sucessórios. Com a implementação do
Código Civil de 2002, a tutela sucessória do(a) cônjuge e do(a) companheiro(a) passou a ter
uma melhor estrutura normativa. Porém, o mesmo apresentou alguns problemas,
principalmente com relação ao artigo 1.790, que tratava sobre o direito sucessório do(a)
companheiro(a) e o(a) colocava numa posição prejudicial em comparação ao(a) cônjuge e aos
demais herdeiros, desvalorizando sua participação e contribuição na herança. Portanto, será
explorado o reconhecimento da equiparação sucessória entre o(a) companheiro(a) e o(a)
cônjuge, onde houveram julgamentos conflitantes entre os Tribunais Estaduais, até ser decidido
pela inconstitucionalidade do artigo 1.790 do Código Civil. Para esse estudo a metodologia
usada é a de análise bibliográfica, que trará em seis capítulos os principais temas acerca desse
assunto, explicando quem são os herdeiros e a posição do(a) companheiro(a) em relação aos
demais; como era a divisão sucessória e a posição do(a) cônjuge antes de depois do Código
Civil de 2002; a inconstitucionalidade do artigo 1.790, que tratava sobre os direitos sucessórios
do(a) companheiro(a) e os motivos de sua inconstitucionalidade; e por fim, a conclusão.
This article aims to analyze the partner’s succession position, considering that the partner has never had the same treatment given to the spouse in the Brazilian Legislation, whatsoever, holding a lower position in the succession compared to other heirs. A common-law marriage and marriage has been described and protected as a distinct family entity, thus a spouse in such a marriage has been distinguished from the partner in a statutory relationship for succession purposes. With the implementation of the Civil Code of 2002, the protection of the spouses’ inheritance and their partner has had a better normative structure after the implementation of the law. However, as for the partner in a partnership, there were some issues, mainly related to the Article 1.790, referring to the Law of Succession in which an inferior position was held by the partner compared to the spouse and other successors, downgrading his participation and contribution in the inheritance. Therefore, the succession equation between the partners in the two distinct relationship institutions, and their acknowledgement will be explored in the paper, besides the conflicting judgments among State Courts, which resulted in the unconstitutionality of Article 1.790 of the Civil Code. The methodology applied in this study is the bibliographic analysis, which involves the main issues about this subject and will be provided for in 6 chapters, explaining who the heirs are, and the partner’s position in comparison to their spouse and other heirs; how the succession division was made, and the spouse’s position before and after the Civil Code of 2002; the unconstitutionality of Article 1.790, which focuses on the partner’s Law of Succession and the reasons of its unconstitutionality; and finally, the conclusion.
