Trata-se de Trabalho de Conclusão de Curso (TCC) na forma de artigo científico apresentado à Faculdade de Direito da Universidade Presbiteriana Mackenzie como requisito para obtenção do grau de bacharel em Direito. Este artigo teve como objetivo identificar a possibilidade de revisão dos contratos de financiamento imobiliário nos casos de superendividamento em prol do direito social à moradia, especialmente à luz do Código Civil, do Código de Defesa do Consumidor e da Constituição Federal. Para tanto, o artigo analisa, além do direito material civil, consumerista e constitucional, (i) decisões judiciais de Tribunais de Justiça, do Superior Tribunal de Justiça e do Supremo Tribunal Federal e (ii) as principais normas regulamentadoras do mercado de crédito brasileiro. Objetivou-se adentrar em casos concretos e identificar a aplicação do direito material pelo Poder Judiciário, bem como a execução do comando constitucional do direito social à moradia pelas instituições públicas e privadas brasileiras. A partir da análise, verificou-se que aos contratos de financiamento imobiliário (i) a repactuação de dívidas prevista no Código de Defesa do Consumidor, em casos de superendividamento, não é aplicável, (ii) o direito material para embasar a revisão contratual – quando o motivo do inadimplemento for o superendividamento – fica limitado ao Código Civil e à Constituição Federal, e (iii) o procedimento extrajudicial para execução dos contratos de mútuo com alienação fiduciária em garantia – constantes na Lei nº 9.514/1997 – é constitucional.
This is a Course Completion Work in the form of an scientific article presented to the Faculty of Law of university Presbiteriana Mackenzie as a requirement to obtain a bachelor’s degree in law.This article aimed to identify the possibility of reviewing real estate financing contracts in cases of over-indebtedness in favor of the social right to housing, especially consideringthe Civil Code, Consumer Protection Code and the Federal Constitution.To this end, the article analyzes, in addition to civil, consumerist and constitutional material law, (i) the judicial decisions of the Courts of Justice, the Superior Court of Justice and the Federal Supreme Court and (ii) the main regulatory standards of the credit market Brazilian. To this end, the objective was to delve into concrete cases and identify the application of material law by the Judiciary, as well as the execution of the constitutional command of the social right to housing by Brazilian public and private institutions.From the analysis, it is reinforced that to real estate financing contracts (i) the renegotiation of debts provided for in the Consumer Protection Code, in cases of over-indebtedness, is not applicable, (ii) the substantive law to support the contractual review -when the reason for default for over-indebtedness -is limited to the Civil Code and the Federal Constitution, and (iii) the extrajudicial procedure for executing contracts with fiduciary alienation as collateral -contained in Law nº9.514/1997 -is constitutional.
