Resumo
The sustainable development theory guides the sustainable exploitation of energy resources to the emancipatory sense of the country and that coincides with the proposal for a "furtadiano” challenge2. This thesis analyses whether Brazilian energy policy is legally structured to respond to the electric sector energy transition focusing on the strategy of matrix diversification through non-conventional renewables. With a support in bibliographical and documentary research the thesis has used the inductive method of approach and it has structured in two parts. The first one has entitled as "Energy Policy and Sustainability" examines the energy policy’s contribution towards for a sustainable development. The first chapter presents the bases for an energy transition proposal demonstrating that state energy policies are being reshaped to equalize the dimensions of energy security in the face of climate change. The second chapter discusses the need to guide the Brazilian’s energy policy towards sustainable development based on the Furtadian challenge. On the second part of the thesis, entitled "The Brazilian Strategy for the Exploitation of Renewable Energy Resources", the third chapter analyses the constitutional treatment of non-conventional renewable sources, by studying their legal nature, the legal categories that enable their appropriation and the division of State competences in its field. Regarding the legal statement dimension - under the constitution -, the fourth and last chapter asks whether the legal structure of energy policy encourages the production and use of non-conventional renewables in the electricity sector from the solar energy source case. At the end, it has pointed out challenges and perspectives that are imposed on the Brazilian State and the community to restructure the energy system on a sustainable basis, concretizing the “furtadiano” agenda.
