O planeta enfrenta um desafio sem precedentes devido ao aparecimento de um vírus letal. Historicamente, as leis têm se adaptado às crises e às necessidades da população diante de eventos disruptivos. Em 2020, foi necessário adotar o isolamento social como resposta ao surgimento do COVID-19 em dezembro de 2019. Originado em Wuhan, na China, o vírus (SARS-COV-2) se espalhou rapidamente, afetando 180 países e influenciando profundamente o campo do direito de família, particularmente em questões como a custódia e o direito de visitação dos filhos, revisão das pensões alimentícias e procedimentos matrimoniais. O direito de família adotou uma abordagem mais empática, enfatizando a necessidade de uma gestão jurídica que reconheça a importância das contribuições interdisciplinares com foco social. Medidas emergenciais foram estabelecidas pela Lei nº 14.010/2020 para endereçar os desafios trazidos pela pandemia. Este estudo focou em examinar as repercussões da pandemia no Direito de Família, adotando uma metodologia descritiva e qualitativa. Fica claro que o sistema jurídico está apto a se ajustar e se alinhar às exigências sociais em qualquer contexto, com o objetivo de salvaguardar direitos essenciais e preservar a ordem social, sustentando a família como pilar fundamental do Estado.
The world has been grappling with an unprecedented challenge due to the emergence of a lethal virus. Historically, laws have had to adapt to crises and the needs of the population in the face of disruptive events. In 2020, social isolation became necessary in response to the emergence of COVID-19 in December 2019. Originating in Wuhan, China, the virus (SARS-COV-2) spread rapidly, affecting 180 countries, and having a profound impact on the field of family law, particularly regarding custody and visitation rights, adjustments to alimony, and procedures related to marriage. Family law has adopted a more empathetic approach, emphasizing the need for legal management that recognizes the importance of interdisciplinary contributions with a social focus. Emergency measures were established by Law No. 14.010/2020 to address the challenges brought by the pandemic. This study focused on examining the repercussions of the pandemic on Family Law, using a descriptive and qualitative methodology. It is clear that the legal system is capable of adjusting and aligning itself with societal demands in any context, with the aim of safeguarding essential rights and preserving social order, upholding the family as the fundamental pillar of the State.
