Acesso à justiça na pandemia: uma análise empírica da busca pela tutela da saúde no Tribunal de Justiça do estado de São Paulo

A compreensão de que o acesso à justiça deve refletir o acesso à ordem jurídica
justa requer a análise social, econômica, política e cultural da sociedade. A análise estrutural
do acesso à justiça ou, ainda, aos órgãos judiciários revela que alguns fatores se antepõem e
configuram-se obstáculos na busca pela tutela jurisdicional. O advento da pandemia impôs
uma nova realidade à população mundial, seja através do distanciamento social, seja da
crescente onda de virtualização das relações. No Brasil, com a imposição de medidas
restritivas de circulação e a necessidade de implementação de políticas de isolamento social,
o Poder Judiciário teve que se adequar à realidade digital imposta de maneira repentina.
Nesse contexto, através do método dedutivo, partindo do pressuposto de que alguns fatores
antecedem e se constituem como obstáculos ao acesso à ordem jurídica justa, buscou-se,
após o levantamento de hipóteses específicas, a partir do método empírico, verificar os
impactos que a necessidade de inserção no mundo tecnológico trouxe na busca pelo acesso
à Justiça em meio à pandemia do novo coronavírus, especificamente no âmbito do direito à
saúde. Assim, realizada pesquisa empírica no Tribunal de Justiça do Estado de São Paulo,
foi analisada a distribuição de ações relacionadas ao direito à saúde no primeiro período
marcado pelo regime excepcional de trabalho remoto no referido tribunal. Como resultado
da verificação que se propôs com o presente trabalho, foi identificada a restrita distribuição
de ações a uma parcela específica da população paulistana.
The understanding that access to justice must reflect access to the just legal order requires social, economic, political and cultural analysis of society. The structural analysis of access to justice, or even to Organs judicial bodies, reveals that some factors overlap and constitute obstacles in the search for judicial protection. The advent of the pandemic imposed a new reality on the world population, whether through social distance or the growing wave of virtualization of relationships. In Brazil, with the imposition of restrictive circulation measures and the need to implement policies of social isolation, the Judiciary had to adapt to the digital reality imposed suddenly. In this context, using the deductive method, based on the assumption that some factors precede and constitute obstacles to access to the fair legal order, after seeking specific hypotheses, using the empirical method, we sought to verify the impacts that the need for insertion in the technological world has led to the search for access to justice in the midst of the new coronavirus pandemic, specifically within the scope of the right to health. Thus, an empirical research was carried out at the Court of Justice of the State of São Paulo, the distribution of actions related to the right to health was analyzed in the first period marked by the exceptional regime of remote work in that court. As a result of the verification that was proposed with the present work, the restricted distribution of shares to a specific portion of the São Paulo population was identified.
