Resumo
O presente trabalho busca analisar a importância do registro do Desenho Industrial, em comparação com a proteção dada ao titular do registro e se este não o tivesse, nos casos de concorrência desleal. A proteção conferida ao titular do registro traz a certeza de que haverá punição aos que infringirem o seu desenho, pois trata-se de um documento avaliado pelo Instituto Nacional da Propriedade Industrial, que confere automaticamente direitos, sendo facultativo ao depositante o exame de mérito pelo respectivo órgão responsável para a acentuação dos requisitos legais. Para a configuração de concorrência desleal, na hipótese de que um agente copiou o objeto de um concorrente, se faz necessário a figuração de quesitos subjetivos, recebendo do legislador tratamento genérico através das normas de repressão à tal ato. Com isso, destacar-se-á a importância do registro para a proteção do mercado, o interesse social e o desenvolvimento tecnológico, no momento em que um agente atua no mercado contrariando à livre concorrência e livre inciativa, uma vez que o titular poderá com o documento para a proteção dos seus direitos, sem ter que, necessariamente, comprovar questões subjetivas da infração.
The present work seeks to analyze the importance of the Industrial Design registration, in comparison to the protection given to the owner of the registry and, if it did not, in cases of unfair competition. The protection granted to the owner of the registration ensures that there will be punishment for those who infringe on his design, as it is a document evaluated by the National Institute of Industrial Property, which automatically grants rights, being optional to the depositor the examination of merit by the respective body responsible for accentuation of legal requirements. For the configuration of unfair competition, in the hypothesis that an agent copied the object of a competitor, it is necessary to figure subjective questions, receiving from the legislator generic treatment through the rules of repression to such act. This will highlight the importance of registration for market protection, social interest and technological development, at the moment when an agent acts in the market in opposition to free competition and free initiative, since the holder may with the document for the protection of their rights, without necessarily having to prove subjective issues of the infraction.
