O presente trabalho visa abordar os aspectos estatísticos, legais, técnicos e sociais que orbitam a moderna discussão sobre a desjudicialização da execução civil no Brasil. O desenvolvimento do trabalho se respaldou essencialmente em pesquisas bibliográficas e análise de dados, bem como em palestras e seminários patrocinados por juristas estudiosos do tema. De início, pretendeu-se explanar a atual conjuntura da execução civil vinculada ao Poder Judiciário, o que se deu através da análise de dados estatísticos que evidenciam os índices de produtividade e celeridade da máquina judiciária e os consequentes reflexos econômicos e sociais advindos deste cenário. Após, objetivou-se discorrer acerca do conceito e principais fatores que caracterizam a desjudicialização, inclusive evidenciando institutos jurídicos desjudicializados em funcionamento no Brasil, além de brevemente descrever os modelos executivos europeus, com foco no exemplo português, que adotaram em menor ou maior grau a desjudicialização. Finalmente, deu-se espaço para a discussão sobre a constitucionalidade e a legalidade da execução desjudicializada, principalmente à luz dos princípios que integram o devido processo legal, adicionando-se considerações sobre os principais aspectos constantes no Projeto de Lei 6.204/2019, recente proposta legislativa que almeja a inauguração de um sistema executivo majoritariamente desjudicializado no ordenamento jurídico brasileiro. De maneira conclusiva, é possível inferir que a desjudicialização é método seguramente eficaz contra a morosidade e a sobrecarga processual que marcam o Poder Judiciário na atualidade, sendo uma próspera alternativa para que se alcance melhorias na efetividade da tutela executiva.
The present study aims to address the statistical, legal, technical and social aspects that orbit the modern discussion about the de-judicialization of civil execution in Brazil. The development of the study was essentially supported by bibliographic research and data analysis, as well as lectures and seminars sponsored by jurists researchers on the subject. At first, it was intended to explain the current situation of civil execution linked to the Judiciary, which occurred through the analysis of statistical data that show the productivity and speed of the judicial machine and the consequent economic and social effects arising from this scenario. Afterwards, the objective was to discuss the concept and main factors that characterize the de-judicialization, including showing de-judicialized legal institutions in operation in Brazil, in addition to briefly describing the european executive models, focusing on the Portuguese example, which adopted the de-judicialization to a lesser or greater degree. Finally, was given evidence to the discussion about the constitutionality and legality of the de-judicialization of execution, mainly in the light of the principles that integrate due process of law, adding considerations on the main aspects contained in the Bill 6.204/2019, a recent proposal legislation that aims to inaugurate an executive system predominately de-judicialized in the brazilian legal order. In a conclusive way, it is possible to infer that the de-judicialization is a method that is certainly effective against the slowness and procedural overload which mark the Judiciary currently, being a prosperous alternative for achieving improvements in the effectiveness of execution.
