Resumo
O artigo em epígrafe buscou analisar as lacunas legislativas presentes no ornamento
jurídico brasileiro a respeito dos animais domésticos (“pets”), em específico no regimento do
processo de execução cível, sob a perspectiva de avaliação quanto à necessidade de alteração da
natureza jurídica desses animais na legislação pátria, que enquanto seres semoventes,
equiparados a bens móveis, estão suscetíveis à penhora. Todavia, conforme será demonstrado,
por meio do método dedutivo de pesquisa, a partir da análise da legislação, doutrina e do
entendimento jurisprudencial, sob um viés filosófico e neurocientífico, para consolidar a
relevante tese de modificação da categoria jurídica dos pets para seres sencientes, com
capacidade de sentir e vivenciar emoções. Além disso, considerando a atual construção social, o
vínculo afetivo entre esses animais e seus tutores se fortificou a ponto de serem considerados
como integrantes das famílias, razão pela qual mostra-se incoerente tratá-los como objeto
suscetíveis à penhora.
The present article aims to analyze the legislative gaps present in the Brazilian legal framework regarding domestic animals ("pets"), specifically the rules of civil execution process, from the perspective of evaluating the need to change the legal nature of these animals in the national legislation, which, as self moving beings, equated to movable property, are subject to attachment. However, as will be demonstrated through the deductive research method, based on the analysis of legislation, doctrine, and jurisprudential understanding from a philosophical and neuroscientific perspective, to consolidate the relevant thesis of modifying the legal category of pets to sentient beings, capable of feeling and experiencing emotions. Therefore, considering the current social construct, the emotional bond between these animals and their guardians has strengthened to the point of being considered as family members, which is why it appears inconsistent to treat them as objects susceptible to attachment.
