dc.description.abstractThis research has as general objective to analyze the legal form of housing, investigating its constitution and its performance. In order to understand the right to the city and its relation to the right to housing, the specific works on the themes by authors Henri Lefebvre and David Harvey were used as a theoretical reference. In this sense, private property and housing were related using the idea of city and housing as a commodity; identifying the state's performance in favor of the interests of capital, in addition to understanding segregation. On the other hand, it was verified that the global city plays its actions in favor of the interests of the financial and real estate market, besides detecting the financialization of housing in Brazil; moreover understanding urbanization as business, through the exercise of strategic planning, to favor the private interests of the real estate market. Finally, it was identified, that housing policies in Brazil are not public, but patrimonial policies, as well as, it was noticed that we did not have a welfare state, on the contrary, a patrimonial society that serves the financial and real estate interests; on the other hand, the theory of the income of agricultural land was related to the theory of location; it was identified the urban planning legal instruments that act in relation to the realization of the right to housing, and it was detected the obstacles that the instruments themselves cause against the achievement of the right to housing; the “Minha Casa, Minha Vida” Program was evaluated based on other researches and it was noticed that the concepts and institutes worked during this thesis are applied to the PMCMV (“Minha Casa, Minha Vida” Program). Finally, we try to prove that the obstacles to the accomplishment of the right to housing are caused by the Law itself and by the State.eng
dc.description.abstractEsa investigación tiene como objetivo general analizar la forma jurídica (de) vivienda, investigando su constitución y su actuación. Para entender el derecho a la ciudad y su relación con el derecho a la vivienda se ha utilizado, como referencial teórico, las obras específicas sobre los temas, de los autores Henri Lefebvre y David Harvey. En ese sentido, se ha relacionado la propiedad privada y la vivienda utilizando, para tanto, la idea de ciudad y vivienda como mercancía; identificando la actuación del Estado en favor de los intereses del capital, además de comprender la segregación. Por otra parte, se ha verificado que la ciudad global desempeña sus acciones en favor de los intereses del mercado financiero e inmobiliario, además de detectar la financiación de la vivienda en Brasil; además de comprender la urbanización como negocio, a través del ejercicio del planeamiento estratégico, para favorecer a los intereses privados del mercado inmobiliario. Por fin, se ha identificado, que las políticas de vivienda en Brasil no son públicas, sino políticas patrimoniales, como también, se ha percibido que no tuvimos un Estado del bienestar social, sino, una sociedad patrimonialista que atiende a los intereses financieros e inmobiliarios; en contrapartida, se ha relacionado la teoría de la renta de tierra agrícola con la teoría de la localización; se ha identificado cuales los instrumentos jurídicos urbanísticos que actúan en relación a la concretización del derecho a la vivienda y, se ha detectado, los entrabes que los propios instrumentos ocasionan contra la efectuación del derecho a la vivienda; se ha evaluado, a partir de otras investigaciones, el Programa Minha Casa Minha Vida (mi casa mi vida) y, se ha percibido, que los conceptos e institutos trabajados durante esa tesis son aplicados al PMCMV. Por fin, intentamos comprobar que los obstáculos relativos a la efectuación del derecho a la vivienda, son ocasionados por el propio Derecho y por el Estado.spa
