dc.description.abstractEsta monografia tem como objetivo a análise da Lei nº 14.118, de 12 de janeiro de 2021, lei responsável por instituir o Programa Casa Verde e Amarela, que foi aprovada e publicada durante o governo do presidente Jair Messias Bolsonaro. O intuito é analisar se a lei está em acordo com a Constituição Federal de 1988, especificamente sobre um ponto interligado em alguns dispositivos da lei que afastaram a implementação de artigos do Código Civil, que versam sobre o impacto do bem no regime de bens dos cônjuges ou companheiros. Isso porque o imóvel não é simplesmente um bem material, mas é fundamentado em sua composição por preceitos constitucionais, como dignidade humana, função social da propriedade, direito à moradia digna. Sendo assim, a análise feita neste estudo é a ponderação dos preceitos abordados pela lei e o que foi instituído como novidade e por fim, questionar a constitucionalidade destes artigos. A metodologia utilizada foi análise do composto da lei de forma qualitativa e descritiva, mediante bibliografia e jurisprudência.pt_BR
dc.description.abstractThis monograph aims to analyze Law No. 14,118 of January 12, 2021, the law responsible for establishing the “Casa Verde e Amarela” Program, which was approved and published during the government of President Jair Messias Bolsonaro. The intention is to analyze whether the law is in accordance with the Federal Constitution of 1988, specifically on an interconnected point in some provisions of the law that departed the implementation of articles of the Civil Code, which deal with the impact of the property on the property system of spouses or partners. This is because the property is not simply a material asset, but is grounded in its composition by constitutional precepts, such as human dignity, the social function of property, and the right to decent housing. Thus, the analysis made in this study is to ponder the precepts addressed by the law and what was instituted as novelty and, finally, to question the constitutionality of these articles. The methodology used was a qualitative and descriptive analysis of the law through bibliography and jurisprudence.pt_BR
