O art. 1.636 do Código Civil de 2002 exclui qualquer possibilidade de atuação do padrasto e da
madrasta na vida do enteado ao definir que o poder familiar será exercido exclusivamente pelo
pai ou mãe, sem qualquer interferência do novo cônjuge ou companheiro. Essa falta de
regulamentação gera dúvidas nas famílias recompostas, que são aquelas construídas entre um
casal, no qual um ou ambos os cônjuges ou companheiros possui filho proveniente de
relacionamento prévio. Não há orientação acerca das funções do padrasto e da madrasta em
relação ao enteado, logo, cada família deve se organizar da maneira que mais achar conveniente,
a fim de alcançar um lar tranquilo. Entretanto, nem sempre este intuito é alcançado, pois a
família recomposta é dotada de membros com diferentes opiniões e experiências, com distintas
expectativas em relação a como o outro deve se comportar no ambiente familiar, o que enseja
conflitos entre seus integrantes. Dessa forma, este estudo tem como objetivo analisar a
autoridade parental nas famílias recompostas, a viabilidade da atribuição de autoridade parental
aos padrastos e madrastas, bem como a atuação destas figuras na vida dos enteados, levando
em consideração a transformação da família, a evolução do direito que a tutela e os princípios
constitucionais relevantes para a orientação das relações na família recomposta. Sob o prisma
do direito comparado, serão analisados o Código Civil Argentino e o Código Civil Alemão, que
tratam da questão e norteiam a conduta dos padrastos e das madrastas.
The article 1.636 of the 2002 Civil Code excludes any possibility of the stepfather and stepmother acting in the life of the stepson by defining that family power will be exercised exclusively by the father or mother, without any interference from the new spouse or partner. This lack of regulation creates doubts in recomposed families, which are those built between a couple, in which one or both spouses or partners has a child from a previous relationship. There is no guidance on the functions of the stepfather and stepmother in relation to the stepson, so each family should organize themselves in the way that they deem most convenient, in order to achieve a peaceful home. However, this aim is not always achieved, as the recomposed family is endowed with members with different opinions and experiences, with different expectations in relation to how the other should behave in the family environment, which leads to conflicts among its members. Thus, this study aims to analyze parental authority in recomposed families, the feasibility of assigning parental authority to stepfathers and stepmothers, as well as the role of these figures in the lives of stepchildren, taking into account the transformation of the family, the evolution of the right that guardianship and the constitutional principles relevant to the orientation of relationships in the recomposed family. Under the prism of comparative law, the Argentine Civil Code and the German Civil Code will be analyzed, which deal with the issue and guide the conduct of stepfathers and stepmothers.
