dc.description.abstractThis study aims to analyze the relationship between ethics and contract, leaving the two hegemonic paradigms of legal knowledge, the natural law and legal positivism, concluding with a critical analysis of the possible existence of a contractual justice in the context of a positivised legal system, albeit with new paradigms supporters. Whereas the concept of law and morality varies according to the historical moment, the economic and social context, the approach regarding the contractual justice will be done taking into consideration the moral and legal thought prevailing in each period, taking as march time the dominant thought in modernity, especially from the eighteenth century.eng
