É de comum entendimento entre a doutrina majoritária a alegação da ausência do contraditório em sede de inquérito policial. No entanto, há certos dispositivos na Constituição Federal e na legislação processual penal que preveem seu exercício na fase preliminar da persecução, ainda que de forma mitigada. A presente obra buscou desmistificar o entendimento quase que padrão sobre o tema e ampliar a discussão, passando por diversos pontos como a posição do contraditório como princípio e direito fundamental na Constituição e sua interpretação protetora, espécies de sistemas de persecução penal e a investigação criminal defensiva. Esta última se mostrou como um meio de efetivação de contraditório pleno na fase pré-processual, haja vista que o defensor passa a praticar ativamente a assistência técnica neste momento. A pesquisa levou a constatar que os debates sobre o tema estão voltando à tona ultimamente, especialmente com alterações realizadas no Estatuto da OAB quanto a presença do advogado na fase preliminar do processo, regulamentação da investigação defensiva pelo Provimento nº 188/2018 e, especialmente, a chegada da Lei nº 13.964/2019, que trouxe efeitos ao Código de Processo Penal de modo a alterar o sistema de investigação como já conhecido, mas encontrando resistência pelos operadores do Direito, tendo seus efeitos suspensos por liminar do STF.
It is common understanding among the majority doctrine to claim the absence of the adversary in the context of a police investigation. However, there are certain provisions in the Federal Constitution and in criminal procedural legislation that provide for its exercise in the preliminary phase of prosecution, albeit in a mitigated manner. The present work sought to demystify the almost standard understanding of the topic and broaden the discussion, passing through several points such as the position of the adversary as a fundamental right and principle in the Constitution and its protective interpretation, types of criminal prosecution systems and defensive criminal investigation. The latter proved to be a means of effecting a full adversarial process in the pre-procedural phase, given that the defender starts to actively practice technical assistance at this time. The survey led to the conclusion that debates on the subject have been surfacing lately, especially with changes made to the OAB Statute regarding the presence of the lawyer in the preliminary stage of the process, regulation of the defensive investigation by Provision No. 188/2018 and, especially, the arrival of Law nº 13.964 / 2019, which brought effects to the Criminal Procedure Code in order to change the investigation system as already known, but encountering resistance by the operators of the Law, having its effects suspended by an injunction of the STF.
