O reconhecimento da filiação socioafetiva e da multiparentalidade no ordenamento jurídico: uma abordagem sobre a cumulação parental no registro civil

Resumo
A presente monografia trata-se de uma pesquisa bibliográfica, com enfoque
constitucional e civil, com o intuito de analisar os institutos da socioafetividade e da
multiparentalidade registral e suas implicações nas diferentes esferas jurídicas, com maior
enfoque no Direito Sucessório, levando em conta que os referidos institutos se apresentam com
significativo valor jurídico e social, desencadeando mudanças nos direitos de âmbito
sucessório. Para viabilizar essa análise, faz-se uma breve contextualização histórica da
dinamicidade do conceito de família e dos arranjos familiares, desde a família patriarcal até a
concepção contemporânea, com influência da afetividade e considerando as alterações no
cenário social e a aplicação de preceitos e garantias constitucionais. Diante disso, reconhecendo
que as relações familiares têm se apresentado cada vez mais complexas, entende-se pela
necessidade de readequação do ordenamento jurídico à nova realidade social, protegendo os
direitos fundamentais daqueles que se inserem nessa realidade, e aplicando os princípios
constitucionais cabíveis, a exemplo do nome, o melhor interesse da criança, a afetividade e a
dignidade da pessoa humana. A partir de então, estabelecida a importância dos institutos da
socioafetividade e da multiparentalidade, evidencia-se o posicionamento doutrinário e
jurisprudencial no sentido de reconhecer a multiparentalidade registral e os direitos e deveres
dela decorrentes, considerando a ausência de hierarquização entre a filiação de origem biológica
e afetiva. Em conclusão, diante da igualdade filial, analisando decisões recentes dos tribunais
nacionais e atentando-se aos efeitos jurídicos do reconhecimento dos institutos objeto de estudo,
a lacuna legal criada pela inexistência de norma que regulamente a aplicação das atuais
disposições sucessórias às famílias reconhecidas nesse novo arranjo não pode implicar em ônus
aos filhos e parentes inseridos nessa realidade. Desta forma, o Poder Judiciário vê-se obrigado
a adotar uma aplicação analógica dos dispositivos, e, entendendo a necessidade da
regulamentação sobre o tema, o presente trabalho trás, ao final, uma breve análise do atual
projeto de lei que objetiva proteger aqueles em relação de filiação afetiva e multiparental,
contemplando um meio protetivo para o cenário apresentado no decorrer deste estudo. Nesse
sentido, conclui-se pela necessidade de regulamentação que legitime os vínculos supra, para
que o Direito reflita essa nova realidade social, demonstrando, portanto, a pertinência deste
trabalho de pesquisa.
This monograph is a bibliographical research, with a constitutional and civil approach, with the aim of analyzing the institutes of socio-affectiveness and multiparental registration and its implications in different legal spheres, with a greater focus on Succession Law, taking into account that these institutes have significant legal and social value, triggering changes in inheritance rights. In order to make this analysis possible, a brief historical contextualization of the dynamics of the concept of family and their arrangements is made, from the patriarchal family to the contemporary conception, with the influence of affectivity and considering the changes in the social scenario and the application of precepts and constitutional guarantees. Given this, recognizing that family relationships have become increasingly complex it is understood the need to readjust the legal system to the new social reality, protecting the fundamental rights of those who are part of this reality, and applying the appropriate constitutional principles, for example the name, the best interest of the child, the affection and the dignity of the human person. From then on, after establishing the importance of the institutes of socio-affectiveness and multiparenting, the doctrinal and jurisprudential positions are evident in the sense of recognizing registered multiparenting and the rights and duties arising from it, considering the absence of hierarchy between the affiliation of biological origin and affective. In conclusion, in view of filial equality, analyzing recent decisions of national courts and paying attention to the legal effects of the recognition of those institutes, object of study, the legal gap created by the lack of a rule that regulates the application of the current succession provisions to families recognized in this new arrangement cannot imply a burden on children and relatives inserted in this reality. In this way, the Judiciary is forced to adopt an analogical application of the devices, and understanding the need for regulation on the subject, the present work brings, at the end, a brief analysis of the current law bill that aims to protect those in affective and multiparental filiation relationship, contemplating a protective means for the scenario presented in the course of this study. In this sense, it is concluded by the need for regulation that legitimizes the bonds above, so that the Law reflects this new social reality, demonstrating, therefore, the pertinence of this research work.
