O objeto do presente trabalho se cumpre em tecer uma análise comparativa acerca do instituto do impeachment nos ordenamentos jurídicos de Brasil e Peru. O referido processo jurídico político, a partir de sua origem na Inglaterra, foi adotado pelos países latino-americanos e ainda que não tenha a adoção oficial, é denominado por impeachment no Brasil, e no Peru, em espanhol: juicio político. A presente análise foi elaborada tanto do ponto de vista legal, esmiuçando os instrumentos legislativos e doutrinários dos países em epígrafe, como também na realização de uma análise prática sob os contextos específicos dos processos de afastamento de Dilma Rousseff (2011-2016) ocorrido em 2016, e Martín Vizcarra (2018-2020) ocorrido em 2020. Ainda que tenham ocorrido diversos casos de uso do procedimento para remoção de seus chefes maiores, para o presente trabalho, foi analisado tão somente os casos recentes de Brasil e Peru na última década. Desde a origem a origem na Inglaterra, o procedimento transpassou aos limites fronteiriços e institucionais e começou a ser usado em países como Estados Unidos, França e por consequência, nos países da América Latina. Através disso, começou a ter diversas mudanças e critérios de acordo com as necessidades de cada região. Nesse sentido, a análise através do método comparativo se cumpre em destacar as similaridades e diferenças do procedimento a partir das especificidades institucionais, sociais e jurídicas de ambos os países e assim, compreender os fenômenos que permearam as experiencias supracitadas.
The object of this work is to weave a comparative analysis about the institute of impeachment in the legal systems of Brazil and Peru. This political legal process originated in England and it was adopted by Latin American countries and even though it has not been officially adopted, it is called impeachment in Brazil, and in Peru, in Spanish: juicio politico. This analysis was prepared both from a legal point of view, analyzing the legislative and doctrinal instruments of the above countries, as well as in carrying out a practical analysis under the specific contexts of the removal processes of Dilma Rousseff (2011-2016) that took place in 2016 , and Martín Vizcarra (2018-2020) occurred in 2020. Although there have been several cases of use of the procedure to remove their major heads, for the present work, only recent cases from Brazil and Peru in the last decade were analyzed. Since its origins in England, the procedure crossed borders and institutional boundaries and began to be used in countries such as the United States, France and, consequently, in Latin American countries. Generating several changes and criteria according to the needs of each region. In this sense, the analysis through the comparative method is accomplished in highlighting the similarities and differences of the procedure from the institutional, social and legal specificities of both countries and, thus, understanding the phenomena that permeated the aforementioned experiences.
