Abstract
Este trabalho tem como objetivo promover uma análise da Constituição de Cádiz à luz dos princípios católicos e do modelo do Antigo Regime. Há evidências implícitas no texto constitucional de que o liberalismo burguês não foi sua base principal, e sim a religião católica. É ressaltada a relevância da invasão napoleônica a Espanha no século XIX e da disseminação dos ideais liberais para intensificar os movimentos constitucionalistas espanhóis que culminaram com a formalização da Constituição de Cádiz. Busca-se, portanto, comprovar que a primeira constituição espanhola não foi tão progressista quanto se quer fazer acreditar, preservando, em grande parte, os poderes e privilégios da Igreja Católica e da Coroa Espanhola e mantendo um sistema elitista no que tange às Cortes de Cádiz e aos processos eleitorais. Assim, a religião católica e a parcela mais privilegiada da população seguiram norteando a ordem jurídica e até mesmo dificultando a clara distinção entre a separação dos Poderes.
This study’s goal is to promote an analysis of the Constitution of Cadiz in the light of the catholic principles and the Old Regime’s model. There are implicit evidences in the constitutional text that the bourgeois liberalism was not its main base but the catholic religion. It is stressed the relevance of the Napoleonic invasion on Spain during the nineteenth century and of the dissemination of the liberal ideals to intensify the Spanish constitutional movements that culminated in the formalization of the Constitution of Cadiz. Therefore, the goal is to prove that the first Spanish constitution was not as progressive as it is led to believe, widely preserving the powers and privileges of the Catholic Church and the Spanish Crown, even keeping an elitist system when it came to the Courts of Cadiz and the electoral procedures. That said, the catholic religion and those who were most privileged kept on guiding the legal order and even hindered the clear distinction of the separation of powers.
