É de suma importância que o empregador possa contar com mecanismos que o permitam conduzir sua atividade econômica, com o auxílio da co-gestão dos exercentes de cargo de confiança. Importa, desta forma, entender o funcionamento da relação trabalhista entre o empregador e o empregado exercente desse tipo de cargo. O presente trabalho trará os aspectos que envolvem as relações jurídicas laborais dos exercentes de cargos de confiança. Primeiramente, aborda-se o princípio protetivo que norteia esse instituto. A seguir, presta-se à análise da diferença entre empregado comum e os empregados exercentes do cargo de confiança. Trata-se também das especificidades do cargo de confiança, seus direitos e deveres, jornada e remuneração, bem como a análise das jornadas especiais de certas categorias profissionais com duração do trabalho diferenciada por força de circunstâncias particulares do tipo de atividade. Finalmente, se prestará à análise da possibilidade de reversão do cargo de confiança para a relação de trabalho comum.
It is extremely important that the employer can count on mechanisms that allows him to conduct his economic activity with the help of the co-management of those who hold positions of trust. Therefore, it is essential to understand the workings of the labor relationship between the employer and the employee holding this type of position. The present work aims to bring aspects that involve the legal labor relations of the holders of positions of trust. Firstly, the protective principle which guides this institute. Next, this paper works on the analysis of the difference between ordinary employees and employees holding positions of trust. It also deals with the specifics of the position of trust, its rights and duties, working hours and remuneration, as well as the analysis of special working hours of certain professional categories with different working hours due to the particular circumstances of such activity. Finally, this paper aims to analyze the possibility of reversing the position of trust to the common work relationship.
