O presente estudo tem por objetivo analisar os cookies e suas políticas, com enfoque ao
tratamento de dados nos termos da Lei Geral de Proteção de Dados (LGPD). Com o
desenvolvimento do mundo digital as pessoas se veem cada vez mais em um ambiente onde seu
consentimento é constante solicitado pelos provedores de internet para a coleta de seus dados.
Como principal ferramenta para a coleta e compartilhamento dessas informações, as empresas
fazem uso da ferramenta de cookies, que executam a tarefa de forma imperceptível pelo usuário,
o que pode colocá-lo em risco. Nesse cenário, os Estados veem produzindo Leis e Regulamentos
com o objetivo de conscientizar e proteger a população, adotando medidas como o
consentimento do usuário como meio para garantir sua privacidade. Assim, os sites vêm
adotando diversas medidas com o intuito de estarem de acordo com as disposições legais.
Todavia, por se tratar de um processo complexo, muitos provedores encontram dificuldade em
fornecer a informação de forma clara ao titular do dado, que acaba por fornecer seu
consentimento sem saber o tratamento que será feito ao dado coletado. Dessa forma, esse estudo
inicialmente traça o desenvolvimento histórico da origem do direito à proteção de dados, para
então seguir sobre como o tema é tratado pela legislação brasileira na LGPD. Em seguida, será
abordada a origem, definição e necessidade dos cookies sob a ótica da LGPD. Posteriormente,
explora-se uma análise sobre o papel do consentimento e do legítimo interesse no tratamento
de dados, visando preservar e assegurar esse direito. Termina-se trazendo uma análise de
políticas de cookies de três grandes empresas.
The purpose of this study is to analyze cookies and their policies, with a focus on data processing under the terms of the Lei Geral de Proteção de Dados (LGPD). With the development of the digital world, people increasingly find themselves in an environment where their consent is constantly requested by Internet providers for the collection of their data. As the main tool for collecting and sharing this information, companies use cookies, which perform the task imperceptibly for the user, which can put them at risk. Against this backdrop, states have produced laws and regulations aimed at raising awareness and protecting the population, adopting measures such as user consent as a means of guaranteeing privacy. Thus, websites have been adopting various measures in order to comply with legal provisions. However, because it is a complex process, many providers find it difficult to provide the information clearly to the data subject, who ends up giving their consent without knowing how the collected data will be processed. Thus, this study initially traces the historical development of the origin of the right to data protection, and then goes on to look at how the subject is dealt with by Brazilian legislation in the LGPD. Next, the origin, definition and necessity of cookies from the perspective of the LGPD will be addressed. This is followed by an analysis of the role of consent and legitimate interest in data processing, with a view to preserving and ensuring this right. It concludes with an analysis of the cookie policies of three large companies.
