Resumo
A indústria da moda, reconhecida pelo seu potencial econômico significativo, enfrenta desafios consideráveis devido à pirataria, que compromete sua integridade e autenticidade. Este artigo visa analisar os impactos sociais e jurídicos da pirataria na indústria da moda, destacando a vulnerabilidade do setor à violação de direitos de propriedade intelectual e a prática da contrafação, enquanto expõe e examina as implicações legais da pirataria para a sociedade e o Estado. Em meio a essas considerações, destaca-se a importância de políticas públicas robustas e estratégias de combate eficientes para proteger a indústria da moda contra a pirataria, visando salvaguardar os direitos de propriedade intelectual e promover a integridade do mercado. Para tanto, adota-se uma abordagem qualitativa com pesquisa documental e bibliográfica, visando a compreensão aprofundada das questões jurídicas e sociais envolvidas.
The fashion industry, recognized for its significant economic potential, confronts significant challenges attributable to counterfeiting, which compromises its integrity and authenticity. This article aims to analyze the social and legal impacts of piracy on the fashion industry, highlighting the sector's vulnerability to violations of intellectual property rights and counterfeiting practices, while exposing and examining the legal implications of counterfeiting to society and the state. Amid these considerations, the importance of robust public policies and efficient combat strategies to protect the fashion industry against piracy is emphasized, aiming to safeguard intellectual property rights and promote market integrity. To achieve this objective, a qualitative approach, complemented by documentary and bibliographic research, is employed to attain a comprehensive understanding of the legal and social issues at play.
