| dc.description.abstract | O presente trabalho tem o intuito de analisar o chamado dano social. A referida modalidade da dano foi pioneiramente tratada por Antônio Junqueira de Azevedo em 2004, falecido professor da Universidade de São Paulo, o qual, em breve ensaio, tratou de uma nova espécie de dano, o dano social, sendo a modalidade que atinge toda a sociedade, num rebaixamento imediato do nível de vida da população. Percebemos que tratar-se-ia de uma nova espécie de dano indenizável, vez que se propõem a punir de maneira exemplar as condutas que causam uma verdadeira intranquilidade social, rebaixando a qualidade de vida da coletividade. Apesar da abstração do termo, a proposta caiu no gosto da doutrina e jurisprudência, parte em razão do prestígio do autor da tese, e parte decorrente da atual valorização do processo coletivo e do recente crescimento da produção acadêmica relacionada à direitos difusos e coletivos, já existindo inclusive acórdãos que versam sobre esta nova modalidade de dano. Não obstante seja uma modalidade de dano já aceita pelos tribunais, ainda existe um lapso na sua aplicação, sendo necessário aguardar o avanço da jurisprudência, para verificar se a nova espécie de dano indenizável será efetivamente aplicada, ou se desdobrará apenas em arcabouço teórico sem muita relevância prática. | pt_BR |
| dc.description.abstract | This work aims to analyze the so-called social damage. The aforementioned modality of damage was pioneered by Antônio Junqueira de Azevedo in 2004, a late professor at the University of São Paulo, who, in a brief essay, dealt with a new kind of damage, the social damage, being the modality that affects the entire society, in an immediate lowering of the population's standard of living. We realize that this is a new kind of indemnifiable damage, as they propose to punish in an exemplary way the behaviors that cause a real social unrest, lowering the quality of life of the community. Despite the abstraction of the term, the proposal fell in favor of doctrine and jurisprudence, partly because of the prestige of the author of the thesis, and partly due to the current appreciation of the collective process and the recent growth of academic production related to diffuse and collective rights, already there are even rulings that deal with this new type of damage. Despite being a type of damage already accepted by the courts, there is still a lapse in its application, and it is necessary to wait for the advancement of jurisprudence, to verify whether the new type of indemnifiable damage will be effectively applied, or will only unfold in a theoretical framework without much practical relevance. | pt_BR |
