Resumo
Este trabalho tem por finalidade analisar o encarceramento em massa, existente em
nossa sociedade, sob a luz de uma análise discriminatória racial. Para isso, a discutição sobre o
que consiste o encarceramento em massa, e como a política prisional se apresenta em nosso
país. A partir da análise de alguns dados obtidos na base de informações penitenciárias, do
Departamento Penitenciário Nacional, observa-se como se comporta a discriminação racial
dentro do cárcere e como os números mostram uma constante desigualdade sociocultural,
reflexo das relações interpessoais e governamentais discriminatória. Conforme evidencia-se a
discrepância de tratamento entre indivíduos negros e brancos perante a justiça, o tema da
seletividade penal será aprofundado, ao discutir as teorias da pena e como ela se comporta ao
ser aplicada. Apesar da Constituição Federal oferecer garantias igual a todos os cidadãos, o
histórico escravista presente no Brasil, ainda deixa marcas de um comportamento
segregacionista e muitas vezes velado, por meio do papel de autoridade, que é evidenciado na
comparação dos números de negros presentes nas universidades e o número de negros
encarcerados. O comportamento que marginaliza os indivíduos de menor poder social e
econômico, não só o exclui de políticas importantes e ações governamentais que deveriam ser
tomadas para promover a igualdade, acaba criminalizando o indivíduo, generalizando o
fenótipo presente na maioria das pessoas que vivem em comunidades e regiões carentes, e
relacionando-as como criminosas e suspeitas, independente do local ou ação que esteja sendo
praticada. Por fim, observamos como é importante entender essa cadeia de agentes e
comportamentos, para obter cada vez mais evidencias de que a discriminação e seletividade é
presente tanto na nossa sociedade, quanto ao âmbito jurídico, acaba reafirmando preconceitos
tradicionais e soberanos. Desta forma, evidenciamos aquilo que está defeituoso no sistema, para
assim, ter a chance de executar transformações reais e que farão a diferença.
This work aims to analyze the mass incarceration in our society, in the light of a racial discriminatory analysis. The discussion about what constitutes mass incarceration, and how the prison policy presents itself in our country. From the analysis of some data obtained in the penitentiary information base, of the National Penitentiary Department, it is observed how racial discrimination behaves within the prison and how the numbers show a constant socio cultural inequality, reflecting discriminatory interpersonal and governmental relations. As evidenced by the discrepancy in treatment between black and white individuals before the courts, the theme of criminal selectivity will be deepened, when discussing the theories of punishment and how it behaves when applied. Despite the Federal Constitution offering guarantees equal to all citizens, the slave history present in Brazil, still leaves marks of segregationist and often veiled behavior, through the role of authority, which is evidenced in the comparison of the numbers of blacks present in universities and the number of blacks incarcerated. The behavior that marginalizes individuals of lesser social and economic power, not only excludes them from important government policies and actions that should be taken to promote equality, ends up criminalizing the individual, generalizing the phenotype present in most people living in communities and needy regions, and listing them as criminal and suspicious, regardless of the location or action being taken. Finally, we see how important it is to understand this chain of agents and behaviors, in order to obtain more and more evidence that discrimination and selectivity is present both in our society and in the legal sphere, end up reaffirming traditional and sovereign prejudices. In this way, we highlight what is defective in the system, so that we have the chance to perform real transformations that will make a difference.
