Resumo
O presente trabalho teve como objetivo estudar o tema da adoção ilegal e o
tráfico internacional de pessoas, tendo como base tanto a legislação brasileira
como os normativos internacionais que regulamentam o assunto, com utilização
de metodologia comparativa para nortear as conclusões auferidas. No primeiro
capítulo, foi analisada a adoção internacional de crianças e adolescentes
brasileiros com foco nas tratativas conferidas pela legislação nacional acerca do
tema. O segundo capítulo do trabalho apresentou o cenário nacional e
internacional sobre o tráfico internacional de seres humanos e a hipótese da
adoção ilegal de crianças e adolescentes neste tipo de crime. Em seguida,
foram verificadas as alterações legislativas propostas pelo Poder Público do
Brasil no combate e prevenção aos crimes ora estudados. Ao final, observou se a eficácia dos ajustes realizados, sendo destacadas as oportunidades de
melhorias no texto legislativo em prol da proteção às crianças e adolescentes,
de forma a proporcionar oportunidades seguras de realocação no ceio familiar,
mesmo que no estrangeiro.
This paper aims to study the illegal adoption and international human trafficking, focusing the Brazilian legislation and international standards that govern the subject using comparative methodology to guide the conclusions. On the first chapter, it was analyzed the intercountry adoption of Brazilians children and adolescents with focus on how the national legislation threats the topic. The second chapter of this work presents national and international scenarios about the understanding of international human trafficking and the possibility of the illegal adoption as one of the ways to concretize this crime. Following, it was looked for the modifications made by Brazilian’s Public Services for combat and prevent those crimes. After, it was studied the efficiency of the changes that were made, also were highlighted the opportunities of changes in national legislations in order to protect children and teenagers, promoting safe chances to relocate to a new family, even if in a other country.
