O objetivo desta obra é compreender a manifestação do terrorismo na sociedade e dissecar seus elementos caracterizadores, apontando que o crime é uma lógica insurrecional dos grupos comumente marginalizados na formação do processo social que, através da violência direcionada, chama atenção para demandas reprimidas e ignoradas pelo Estado. Será posto o esforço da comunidade internacional em chegar a um consenso sobre a tipificação do terrorismo, visando apresentar razoável definição indicativa aos países que desejam criminalizar em seu ordenamento jurídico as consequências psicossociais oriundas desse fenômeno. Sobreleva notar que o terrorismo, por não ser propriedade de nenhuma ideologia ou movimento, pode ser expediente utilizado por qualquer grupo minimamente organizado e estruturado para cometer atos com a finalidade de incutir terror social ou generalizado. Assim, do mesmo modo que um espectro maligno se apodera de um corpo insepulto, caberá responder se determinadas ações violentas desencadeadas pelas máfias podem ser caracterizadas como terrorismo e, ainda mais, se a legislação brasileira, sob a égide da lei 13.260/16 colimada a lei 12.850/14, é capaz de criminalizar como terrorismo a violência especializada das facções criminosas que dominam o sistema penitenciário doméstico. O método de pesquisa empregado é ostensivamente qualitativo, fazendo incursões no direito alienígena e fundamentando a argumentação através da doutrina selecionada.
The objective of this paper is to comprehend the manifestation of terrorism in the society and to dissect its characterizing elements, pointing out that crime is an insurrectional logic of the groups that are commonly marginalized in the formation of the social process that, through the directed violence, calls attention to repressed and ignored demands by State. The international community will endeavor to reach a consensus on the typification of terrorism, aiming to present a reasonable indicative definition to countries that wish to criminalize in their legal system the psychosocial consequences of this phenomenon. It is worth noting that terrorism, for not being the property of any ideology or movement, can be used as an implement by any minimally organized and structured group to commit acts with the intention of instilling social or generalized terror. Therefore, similarly as a malignant specter seizes an unburied body, it will be necessary to answer if certain violent actions unleashed by the mafias can be characterized as terrorism and, even more, if the Brazilian legislation, under the aegis of Antiterrorism Act collimated to the Organized Crime Act, is capable of criminalizing as terrorism the specialized violence of the criminal groups that dominate the domestic penitentiary system. The research method employed is ostensibly qualitative, making incursions into foreign law and grounding an argument through the selected doctrine.
