O uso de dados de terceiros, pelas empresas prestadoras de serviço, está
crescendo exponencialmente, o que gera, consequentemente, o mau uso de tais
informações. Ainda, a regulamentação insuficiente sobre o tema favorece a situação
atual de aproveitamento e venda desses dados pelas companhias, hoje em dia
considerados ativos. O presente texto visa analisar a qualidade desses dados como
ativos e meios de inovação das empresas, bem como as vantagens e desvantagens
do uso deles por esses agentes de tratamento (operadores e controladores). Assim,
considerando que estas empresas controlam e gerenciam essas informações, busca se identificar as responsabilidades e eventuais punições aplicáveis às companhias,
sob a visão da LGPD, que entrou em vigor em agosto de 2020. Ademais, realizar-se á a comparação sobre os direitos à segurança e à privacidade pelo titular, referente
às suas informações, a fim de identificar um equilíbrio entre a aplicação destes. Por
fim, este texto desenvolve no âmbito jurídico, digital e tecnológico uma análise jurídica
da utilização, armazenamento e dever de guarda das empresas para com os dados
de terceiros.
The amount of data from third parties being used by service provider companies is growing exponentially, which generates, consequently, the bad use of this information. Still, the insufficient regulation about the subject favors the current situation of unfair advantage and sale by the company of this data, considered now as an asset. This text’s goal is to analyze the quality of the data as assets and as a way to innovate for companies, such as advantages and disadvantages of data usage by these ‘treatment agents’ (operators and controllers). Therefore, considering these companies control and manage this information, one of the goals is to identify responsibilities and any applicable punishments to those businesses, under the light of the Brazilian law regarding data protection (“Lei Geral de Proteção de Dados – LGPD”), that entered into force on august of 2020. In addition, security and privacy, as rights, regarding the owner of the data, will be compared in order to identify a state of equilibrium over their applicability. Lastly, this article develops on the legal, digital and technological scope, a legal analysis of the usage, storage and guard duty of companies towards third party data.
