Este trabalho teve como objetivo principal analisar a realidade das condições de saúde dos detentos dentro do sistema penitenciário brasileiro e como a legislação brasileira ampara a saúde no cárcere. Buscou-se compreender, primeiramente, quais são as condições em que se encontram os estabelecimentos prisionais a fim de entender qual é a realidade vivida pelos detentos e como estão sendo tratados. Para isso, utilizou-se da pesquisa bibliográfica, literária, além dos dados analisados obtidos do Levantamento Nacional de Informações Penitenciárias (INFOPEN) para entender as condições socioeconômicas dessas pessoas e os empecilhos ao pleno direito à saúde. A partir dos dados analisados, foi revelada uma precariedade na estrutura entre muitos estabelecimentos prisionais brasileiros e a sua dificuldade de efetivação de direitos e garantias fundamentais dos detentos, demonstrando total desrespeito aos principais dispositivos que garantem o direito à saúde no cárcere, como a Constituição Federal, Código Penal, Código de Processo Penal, Lei de Execução Penal e outros diplomas normativos nacionais e internacionais. Conclui-se que apesar das legislações brasileiras garantirem o direito à saúde aos apenados, a realidade do sistema penitenciário do país demonstra ser precária e insalubre, especialmente após o surgimento da pandemia da Covid-19, ocasião em que se escancarou a deficiência desse sistema.
The main objective of this study was to analyze the reality of the health conditions of inmates within the Brazilian prison system and how the Brazilian legislation supports health in prison. It was sought to understand, first, what are the conditions in which the prisons are located in order to understand what is the reality experienced by the detainees and how they are being treated. For this, it was used the bibliographic and literary research, besides the analyzed data obtained from the National Survey of Penitentiary Information (INFOPEN) to understand the socioeconomic conditions of these people and the obstacles to the full right to health. From the data analyzed, it was revealed a precarious structure among many Brazilian prisons and their difficulty in enforcing the fundamental rights and guarantees of the detainees, showing total disregard for the main provisions that guarantee the right to health in prison, such as the Federal Constitution, Penal Code, Code of Criminal Procedure, Law of Criminal Enforcement and other national and international normative diplomas. It is concluded that despite the Brazilian laws guaranteeing the right to health to prisoners, the reality of the prison system in the country shows to be precarious and unhealthy, especially after the emergence of the Covid-19 pandemic, occasion when the deficiency of this system became clear.
