Resumo
The enforcement of human rights is not limited by the argument of sovereignty making it difficult for external bodies to restore the domestic legal order, nor can it be left to the host States alone to finance the public reception policies of migrants and refugees, which is a global mission. To illustrate the inadequacy of international mechanisms in guaranteeing the effectiveness of human rights, Venezuela is the case study used to observe the actual local crisis being shifted to other states whose public services are burdened by the unforeseen population increase. Given this scenario, in this study, it has been analysed the national and international judicial documents produced, the official statistics on human mobility, the refugee reception programs as well as judicial decisions, doctrine of Constitutional Law, International Law, International Law of Human Rights and International Law of Refugees. It is expected to demonstrate here, that the application of the human rights is above any argument over sovereignty to obstruct the performance of external bodies for the restoration of the internal legal order and urgent humanitarian assistance, as well as it cannot be left exclusively to the States hosting the migrants and refugees the task of financing public policies alone, as this is a global mission.
