dc.description.abstractO presente artigo científico aborda a questão da impossibilidade de colaborações premiadas por investigados presos preventivamente, especialmente perante crimes de colarinho branco. A delação premiada, embora seja uma ferramenta essencial no combate ao crime, levanta preocupações quando obtida sob pressão decorrente de prisões preventivas, podendo ter como consequência, a nulidade do acordo. O estudo busca analisar a legalidade desses acordos, explorando os limites éticos e jurídicos quando a obtenção de colaborações é influenciada pela coação da liberdade dos investigados, evidenciando a inobservância de seu requisito de validade, qual seja, a voluntariedade. A pesquisa propõe uma análise crítica das práticas associadas a acordos de delação premiada, destacando os riscos de abusos e violações dos direitos individuais que podem surgir em contextos de prisões preventivas coercitivas, analisando também a evolução histórica e o progresso da justiça colaborativa desde seus primórdios até a configuração atual, perante o contexto vigente da operação Lava Jato.
dc.description.abstractThis scientific article addresses the issue of the impossibility of rewarded collaborations by those investigated in preventive custody, especially in the case of white-collar crimes. Plea bargaining, although it is an essential tool in the fight against crime, raises concerns when obtained under pressure resulting from preventive arrests, which may result in the nullity of the agreement. The study seeks to analyze the legality of these agreements, exploring the ethical and legal limits when obtaining collaborations is influenced by the coercion of the freedom of those investigated, highlighting the non-observance of its validity requirement, that is, voluntariness. The research proposes a critical analysis of the practices associated with plea bargain agreements, highlighting the risks of abuses and violations of individual rights that may arise in contexts of coercive preventive arrests, also analyzing the historical evolution and progress of collaborative justice from its beginnings to the current configuration, given the current context of the Lava Jato operation.
