Violência obstétrica: uma análise da atuação do Tribunal de Justiça do Estado de São Paulo

No Brasil, a inobservância de diretrizes nacionais e internacionais estabelecidas pelas
organizações competentes, na busca de promover atendimento adequado e respeitoso durante a
gestação e o parto, tem gerado reflexos negativos na vida de mães e bebês. As práticas médicas
relatadas por mulheres que deram à luz apontam para uma em cada quatro mulheres vítima de
violência obstétrica no país, que possui altos índices de cesarianas e de mortalidade materna,
contrariando as diretrizes estipuladas pela Organização Mundial da Saúde. Este artigo
pretendeu identificar como o Tribunal de Justiça do Estado de São Paulo se posiciona diante
dos casos que envolvem a prática da violência obstétrica. Para isso, realizou-se a análise de 28
decisões colegiadas proferidas sobre o tema. Concluiu-se que a maioria dos acórdãos apresenta
parecer desfavorável às mulheres que alegam ter sofrido violência obstétrica, e que o sucesso
da demanda é variável a depender do desembargador, da turma julgadora, do uso de legislação
específica sobre o tema, bem como de diretrizes nacionais e internacionais que tratam da
violação do direito das mulheres e bebês.
In Brazil, the non-observance of national and international guidelines established by the competent organizations, in the search to promote adequate and respectful care during pregnancy and childbirth, has generated negative effects on the lives of women and babies. The medical practices reported by women who gave birth point to one in four women who are victims of obstetric violence in the country, which has high rates of caesarean sections and maternal mortality, contrary to the stipulations of the World Health Organization. This article intended to identify how the Court of Justice of the State of São Paulo is positioned in the face of cases involving the practice of obstetric violence. For this, 28 collegiate decisions handed down on the topic were analyzed. It was concluded that most of the judgments present an unfavorable opinion to women who claim to have suffered obstetric violence, and that the success of the demand varies depending on the judge, the judging group, the use of specific legislation on the subject, as well as guidelines national and international law dealing with the violation of the rights of women and babies.
