O presente artigo tem por objetivo analisar a responsabilidade civil dos provedores de internet ante vicios do produto, sob otíca da legislação brasileira, usando como base o Código de Defesa do Consumidor e o Código Civil, consultando também leis específicas como o Marco Civil da Internet e o Lei Geral de Proteção de Dados. Sendo utilizado também referênciais bibliograficos, doutrinas, sites e jurisprudencias. Sabendo que a atual situação em que o mundo encontra-se exige de nós que usemos cada vez mais a internet como meio de comunicação em áreas, como: educação, trabalho, transações comerciais, entre outras. Visto que, a internet passou a fazer parte de rotinas importantes da vida, questões relacionadas a responsabilidade civil dos provedores de internet ante vicios do produto e serviços começam a surgir. Assim, veremos que o Código de Defesa do Consumidor adota, em seus artigos 12 e 20, a responsabilidade objetiva como como fundamento para reparação de danos provocados por acidentes de consumo causados por vicios de produto ou serviço. Bem como, trás hipóteses excludentes de responsabilidade. Vale lembrar, que além das excludentes previstas em lei, os provedores prevem em seus contratos situações nas quais não poderão ser responsabilizados, sobre as quais traremos uma reflexão com base nos artigos 24, 25 e 51 do código de defesa do consumidor. Logo, analisaremos as hipóteses onde existem a responsabilidade civil dos diversos tipos de provedores de internet, visto que estes, por força de contrato, são responsaveis por garantir o acesso dos consumidores a rede mundial de computadores.
This article aims to analyze the civil liability of internet providers in relation to product flaws, under Brazilian law, using the consumer product safety act and the Civil Code as the main prisms. however it also consult more specific laws such as the "Marco Civil" of the internet and the General Data Protection regulation. it has also being used bibliographic references, doctrines, electronic websites, as well as jurisprudence knowing that, the current situation that the world finds itself in requires for us to increasingly use the internet as a way of communication in several areas, such as education, work, business transactions, among others. as long as the internet became part of important routines of contemporary life, issues related to Internet providers' civil liability in relation to products and services flaws started to appear. In this way, we are going to see that the consumer product safety act adopts, in Articles 12 and 20, strict liability as a basis for repairing damages caused by consumption accidents caused by product or service flaws. As well it brings exclusionary assumptions of liability. It is worth remeding that, futher addition to the exclusions provided by law, the providers predict in their contracts situations that they will not be held responsible, which we will bring a reflection based on articles 24, 25 and 51 of the consumer product safety act. Thus, we analyze the hypotheses where there is a civil liability of the different types of internet providers, since these, by virtue of the contract, are responsible for guaranteeing the access of consumers to the world wide web.
