O presente trabalho teve como objetivo compreender como o direito eleitoral se comporta no
âmbito digital, para entender seus limites e normatizações dentro deste novo meio tão presente
na vida atual. Dentro destes limites, buscou-se entender como funcionam as fake news, que são
um fenômeno amplamente utilizado dentro do meio eleitoral digital, tanto atualmente quanto
nas eleições presidenciais de 2018 – nesse ponto, também foi elaborada breve análise sobre o
cenário mundial e a utilização do instituto das notícias falsas. Diante dessa perspectiva, buscou se entender se a tipificação dessas fake news como crime punível no Direito Brasileiro
infringiria os limites da liberdade de expressão, assegurados pela Constituição Federal de 1988
e, nesse escopo, foi realizada análise dos atuais mecanismos de “combate” às fake news em
trâmite de aprovação nos órgãos competentes.
This monography aims to understand how electoral law behaves in the digital scope, to understand its limits and provisions within this new universe, which is so present in the current life. Within these limits, we sought to understand how fake news, a new phenomenon widely used within the digital electoral environment, works, both today and in the 2018 presidential elections – at this point, a brief analysis was also elaborated on the world’s scenario and the use of the fake news institute. In view of this perspective, it was sought to understand whether the classification of these fake news as a punishable crime under the Brazilian law would violate the limits of freedom of speech, ensured by the Federal Constitution of 1988 and, within this scope, an analysis of the current mechanisms to “fight” against fake news pending approval by the competent federal bodies was also made.
